Official Cacao Barry L'Art du Chocolatier Challenge 2012 Rules
NO ENTRY FEE. VOID WHERE PROHIBITED BY LAW.
ELIGIBILITY
Cacao Barry L’Art du Chocolatier (“Contest”) is open to all professionals (as defined below) who are at least 21 years of age (at the time of entry), and who are legal U.S. residents, living within the fifty (50) United States or the District of Columbia. A professional is defined as any individual employed in the culinary industry as a pastry chef (or assistant) or chocolatier, during the Contest Entry Period. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and the respective household members, of Barry Callebaut ("Sponsor"), its affiliates, subsidiaries, divisions, agents, distributors, advertising and promotion agencies, are not eligible to participate. Sponsor reserves the right to disqualify participants who violate these Official Rules or interfere with this Contest in any manner.
HOW TO REGISTER
There are two steps to follow to enter the Contest: 1) Entrants must register by following the registration process on www.lartduchocolatier.com ("Web Site") between 12:00:01 am ET on 9/10/2012 and 11:59:59 pm ET on 11/23/2012; 2) Entrants must ship qualifying components ON Monday, November 26, 2012, namely: 1 portfolio, 1 gateau de voyage and 2 spreadable paste jars so that they are received at the Barry Callebaut Chocolate Academy, Attn: Alexandra Foster, 600 West Chicago Avenue, Suite 860, Chicago, IL 60654 on November 27, 2012 OR November 28, 2012. ¬Full instructions and requirements regarding the materials, including judging criteria, can be found on this Web Site.
Submission of an entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify such entry in any way (including modification of recipes), in any and all media, without limitation, and without consideration to the entrant. Submission of any entry further constitutes the entrant’s consent to irrevocably assign and transfer to the Sponsor any all rights, title and interest in the entry, including, without limitation, all copyrights. By entering each entrant grants Sponsor permission to use their entries, and their names, biographical information and likenesses for publicity purposes without further compensation in any and all media now known or hereinafter without territorial restriction (except where prohibited by law). Entrant also agrees to the use of his/her email address for future contacts and promotions from Sponsor.
HOW TO WIN
There are two judging rounds, the preliminary round and the final round.
First Round: In the first round, up to 8 finalists will be chosen by experienced chefs using the published judging criteria from all eligible entries received on November 27 and November 28, 2012. The finalists will be selected and announced the first week of December 2012.
Finalists will be notified by email and telephone of their selection. Finalists who respond within 48 hours will be sent a winner’s affidavit/assignment and publicity/liability release and will have 7 days from the time they receive these materials to return them to Sponsor. Finalists must be able to travel to Barry Callebaut Chocolate Academy in Chicago to compete in the actual competition which will take place May 17-18, 2013. Finalists who do not respond by the deadlines or cannot attend the competition are subject to disqualification.
Final Round: Finalists will be required to ship their 2 finished gâteaux de voyage and their 2 jars of spreadable paste to the Chocolate Academy (same direction as before) ahead of time. These are to be shipped ON Monday, May 13. To be received on Tuesday, May 14 or Wednesday, May 15, 2013.
*If you will be in Chicago or are located here, you are welcome to drop off these items on Monday, May 13 ONLY. Otherwise, you will need to ship.
The gâteaux de voyage and spreadable pastes must be identical to the ones submitted for the finalist selection. Finalists will also be required to prepare over two days: chocolate tablets, chocolate showpiece, desserts in a glass and sugar confections over a total of eight hours (to be specified). All of the items will be judged by a panel of culinary experts based on the published judging criteria.
PRIZES
Finalists:
Will each receive round trip airfare to Chicago and hotel accommodations for two (2)- three (3) nights in Chicago.
Air fare is round-trip, coach class air transportation to and from the major airport nearest the winner’s home to Chicago. Travel itinerary and hotel accommodations will be booked by Sponsor. Surprise gift bag and food industry publication shall be chosen by Sponsor in its sole discretion. All expenses not listed (including any overnight stay required en route to/from destination), are the responsibility of the winner. Winner must have or obtain valid identification and/or other travel documents. Sponsor does not take out travel or shipping insurance, and finalists and winners are totally responsible for any personal injury or property damage related to their participation in or travel associated with the Contest or receipt of any prize.
The Grand Prize winner (1) will also receive: a check in the amount of $4,000, a Chicago Barry Callebaut Chocolate Academy class coupon (winner is to select any class (1) of their choice within 12 months of the competition), round trip airfare to Chicago; hotel accommodations for three (3) nights; a surprise gift bag (TBD); and a shared feature in a leading Food Industry Trade Publication (TBD by Sponsor).
The Second Prize winner (1) will also receive: a check in the amount of $2,500; a Chicago Barry Callebaut Chocolate Academy class coupon (winner is to select any class (1) of their choice within 12 months of the competition); a surprise gift bag (TBD); and a shared feature in a leading Food Industry Trade Publication (TBD by Sponsor).
The Third Prize winner (1) will also receive: a check in the amount of $1,500; a Chicago Barry Callebaut Chocolate Academy class coupon (winner is to select any class (1) of their choice within 12 months of the competition); a surprise gift bag (TBD); and a shared feature in a leading Food Industry Trade Publication (TBD by Sponsor).
AGREEMENT TO OFFICIAL RULES/RELEASES
By entering, entrants agree to abide by and be bound by these rules and the judges’ decisions, which are final and binding in all matters related to this contest. Prize is non-transferable. No cash redemption or substitution permitted, except by Sponsor, who may substitute a prize (or element of a prize) of equal or greater value. Any and all federal, state, and local taxes, and any other related expenses on prizes, if any, are the sole responsibility of the winner. Any form of entry other than as specified in these rules is prohibited.
By accepting prize, finalists and winners release and agree to hold harmless Sponsor its parent, affiliates, subsidiaries, distributors, retailers, and/or any of their respective shareholders, directors, officers, distributors, employees or promotion/advertising agencies from any liability whatsoever for any injuries, losses, harm, damage, cost, or expense arising from or in connection with participation in this contest or any prize related activities, or the acceptance, possession, use and/or misuse of a prize including, without limitation, any personal injury or death. By accepting prize, winner acknowledges that Sponsor, its parent, affiliates, subsidiaries, distributors, retailers, and/or any of their respective shareholders, directors, officers, distributors, employees or promotion/advertising agencies have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including but not limited to its quality or merchantability, or fitness for a particular purpose. By entering the Contest, participants agree to assign any and all rights relating to their original recipes to Sponsor. Acceptance of prize further constitutes winner’s consent that the Sponsor may use winner’s name, state of residence, likeness, biographical information and recipe worldwide without limitation for advertising or promotional purposes without further compensation, except where prohibited. All Federal, State, and Local laws and regulations apply.
ADDITIONAL TERMS: VERIFICATION
All recipes must be the original work of the entrant; may not have won previous awards; may not have been published previously; must not infringe any third-party rights; must be suitable for publication; and are subject to verification. Any attempt to defraud Sponsor or the competition judges in any way will be prosecuted to the fullest extent of the law. Neither Sponsor, Administrator nor their agents are responsible for lost, delayed or damaged mail; lost, interrupted or unavailable network, server, satellite, or other connections, availability or accessibility; or miscommunications, failed computer, telephone or cable transmissions, lines, or technical failure; or jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties; or any other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of the Contest, as solely determined by the Sponsor, will be disqualified, and Sponsor reserves the right to terminate such entrant’s eligibility. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Contest, and select a winner as deemed fair and appropriate by Sponsor. Sponsor reserves the right to extend contest entry period in the event of insufficient entries. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, technical failure, theft or destruction, or unauthorized use in connection with the purchase transaction entry portion or any other portion of the Contest.
In no event will Sponsor, its parent, affiliates, subsidiaries and related companies, their respective advertising or promotion agencies or any of their respective Officers, Directors, Employees, Representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the website or downloading from and/or printing material downloaded from www.lartduchocolatier.com or any other website associated with this Contest. Without limiting the foregoing, everything on the Web Site is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations or exclusion of implied warranties so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions. Sale of chocolate is subject to terms and conditions of Web Site and are also available through Sponsor’s distributors. Only registered entrants are allowed to purchase special competition priced items on the Web Site. Entrants are required to use Cacao Barry products from the approved list. Approved list is available on the “Enter Contest Now” page on the Web Site.
